    Googled, and apparently, according to authorities, at least one boy has been charged with 10 counts under Louisiana’s law for distributing AI-generated nude images. So, yes, the school wasnt just wrong here. They were utterly incompetent. Someone, more than one someone, needs to be fired.

    At some point we’re going to either recognize that using someone’s likeness this way without consent is a form of violence, or we’re basically going to lose all rights over our image and likeness. Either everyone has deepfake porn made of them or no one does.

    That question probably won’t be seriously tested until it happens to someone with enough money and power to matter, though.

      In Louisiana, the penalty for the creation or possession of a deepfake of a minor is imprisonment for 5 to 20 years, and a fine up to $10,000. Mandatory minimum is at least 5 years. And they must be served without parole, probation, or suspension of sentence.

      Seems that Louisiana already considers this an act of violence, and treats it accordingly. The school should be in deep shit here, and the police say that there is a kid being charged with 10 counts of distributing AI generated nude images. I very much doubt he’ll be tried as an adult, but I dont see him just walking away from this.

      The school though? They had a report of AI generated child abuse images being distributed, and they didnt immediately report it. That isnt just wrong, thats illegal as Louisiana has mandatory reporting laws, and doesnt make a distinction between real and deepfake child abuse images. The school had not only a moral duty, but a legal duty to act. And it didnt. That school, is fucked. The family can sue for millions, and whichever teachers failed to act, could be on their way to jail and will find themselves personally liable for their failure to act as well.

      What the fuck are you on about celebrities have been deepfaked since before deepfakes. Trump was deepfaked nude on international television by southpark. Taylor and Scarlet’s lawyers have pretty much defined the laws around it.

      That question probably won’t be seriously tested until it happens to someone with enough money and power to matter, though.

      She also needs financial compensations. Ideally in the 10s of thousands. Let her have that money as well, fuck it.

    What the fuck. Why is this is a question. Why would it even be possible to criminally charge the victim. Why are you acting like you’re doing her a favor by not “pursuing charges”. WHAT fucking charges would you be fucking pursuing.

    I don’t expect commenters to know the answers to this. I just want to emphasize how American cops hate women so fucking much that when they have a 13-year-old female victim of a sex crime they ask themselves what crimes they can charge her with.

    And men wonder why women don’t report.

      100% agree she should not be charged as I believe it’s 100% justified here, but to say you don’t know what they would charge her with when it’s pretty clear… That said, it should be understood that when someone does something that deserves a slap or a punch or a kick, while the person might be guilty of the crime, the justification means you do not pursue it. Like the father who catches the guy messing with his kid and he kills the guy. Yes it’s Murder 2 but you don’t charge him if there’s a decent bone in your body. You help him get the body off his property so he can tend to his child.

      I also agree the focus should be on the actual crime, the guy making CP of a minor. Even if he used technology to fake it. It’s still portraying a child; ergo, it’s CP. The focus should be on him being placed on a sex offender registry for however many years. But, it’s Louisiana so who knows. The girl would have no rights, especially if she has dark skin.

      A long, long time ago, someone told me that crimes are committed separately. (I don’t even remember the person who told me this.) The situation that was discussed in that conversation was that a burglar had entered a home illicitly, fallen due to some code violation, and hurt themself.

      The homeowner was able to conduct a case against the invader, but the criminal was also able to sue for … Whatever you sue for when you get hurt in someone else’s house. Neither jury was allowed to know the details of the other’s case, or perhaps they were instructed to disregard their knowledge.

      The point is, in one possible suit the person we would likely agree is the victim is legally the victim; and in the other they are legally the perpetrator. According to the law, the two are not relevant to each other.

      … Is what I was told decades ago by this person I barely remember.

      Sue the fuck out of the kid that made the deepfake. I’m sure any good law firm could deliver some emotional distress, defamation, whatever. Maybe she’d get community service at 13 if charged, but creating a wreckage of the school district and the kid that did it would send a message. Worst thing is that the taxpayer would be on the hook to pay for any compensation, not the shitty people at the district choosing to punish her.

        A child hitting another child isn’t a crime that requires an arrest, trial, and conviction. It’s a discipline issue that requires teachers to call the kids’ parents.

        And honestly? A kid creating deepfake porn is a much more serious discipline issue, but it’s still a discipline issue, because a middle school boy is still a fucking child. That kid should have been expelled and sent to therapy, but not arrested, because, again, child.

        Arresting a child for anything is insane - but private prisons profit off that insanity, and conservatives love the idea of black babies growing up to be prison labor, so the school-to-prison pipeline ruins more children’s lives every day.

        God, some people out there would have parents call the cops whenever their kids get in a fight. I hate this century.

      I mean rhe girl moved in with her dad in 2020 and hadn’t been to school since. I imagine she kind of fell through the cracks during covid as far as school goes. All of the adults in that house belong in super jail though.

    I got suspended for defending myself against getting hit in the head with a chair when I was a kid. School policies are totally fucked. Guess they just wanted me to stand there and sustain massive head trauma? Assholes.

      I got jumped in 10th P.E. in the locker room by a bunch of guys in the class. I got in trouble for defending myself with a weapon (locker padlock) and forced to apologize to my attackers who were not punished in any way.

      In 12th grade in another state, I got attacked by a bully. I happened to have on me a rusty box cutter that I almost threw away that morning because it was falling apart. For some reason, I put it in a pocket instead. When I was attacked, I remembered it and used it. I got suspended for 3 days but the bully had to get tetanus shots.

      When I was in school, if someone hit you over the head with a chair and you didn’t fight back, you still got suspended because you were “involved” in a fight.

      I got a friday night detention for throwing one punch at a student who was attacking me. I threw that punch after descalation did not work, and as soon as I saw a teacher I signalled for help. My dad confronted the vice principle who was the one who gave me the punishment and my dad asked him what I should have done. The VP told my dad I did as I should have and as what was expected, but that the school has a zero tolerance policy so I still needed to be punished.

        Yep, if you’re getting suspended no matter what you do, might as well go to town so that everyone else is to afraid to try again next time because of what happened to the last attacker.

        Effectively, it’s an enticement to escalate violence rather than try and diffuse the situation once violence starts.

        Yep. I have been suspended twice for fighting. In both cases the other person hit me first. The first time it happened I didn’t even realize somebody had thrown a punch and had no time to even defend myself. The second time I did defend myself, but it literally involved pushing the person away.

        In both cases the school administration did not care and my parents went up to the school to make complaints.

        It’s bullshit, but this is exactly the problem. Schools have zero tolerance policies to protect themselves rather than to protect students.

      Ya many schools have taken a zero tolerance route which means you don’t really get any punishment expect for expulsion. Something like that should have been handled in a much different way.
